§ 1 Scope, Provider
These General Terms and Conditions (hereinafter „Terms") apply to all contracts concluded between the provider and consumers (hereinafter „Buyer") regarding the sale of gift vouchers via the website ryeanddry.de.

§ 2 Subject of the Contract
The subject of the contract is the sale of gift vouchers redeemable at Rye & Dry Bar for all services offered on the premises (food, drinks, events, tastings). The vouchers are multi-purpose vouchers within the meaning of § 3 (14) of the German VAT Act (UStG).
Cash payment of the voucher amount is not possible.
§ 3 Conclusion of the Contract
The presentation of the gift vouchers on the website does not constitute a binding offer, but an invitation to the Buyer to submit an offer.
By entering the order details and confirming the order via the „Continue to payment" button, the Buyer submits a binding offer to conclude a purchase contract. The contract is concluded upon the provider's confirmation email, which is sent immediately after successful payment.
§ 4 Prices and Payment
The prices stated on the website at the time of the order apply. All prices are final.
Since these are multi-purpose vouchers, value-added tax is only incurred upon redemption of the voucher at the bar, not at the time of purchase.
Payment is made online via the payment service provider Stripe (Stripe Payments Europe, Ltd.). The payment methods displayed during the checkout process are available (in particular credit and debit cards, Apple Pay, Google Pay).
§ 5 Delivery of the Voucher
After successful payment, the gift voucher is sent to the Buyer as a PDF file via email to the address provided during ordering. Delivery typically occurs within a few minutes.
Should the email not arrive within 60 minutes, the Buyer is asked to check their spam folder and, if necessary, contact bar@ryeanddry.de.
§ 6 Redemption of the Voucher
The voucher can only be redeemed at Rye & Dry, Methfesselstraße 88, 20255 Hamburg, Germany.
Partial redemption is possible. Any remaining balance stays on the voucher and can be redeemed later. Change will not be paid out in cash.
The voucher is valid for three years from the end of the year of purchase (in accordance with the statutory limitation period under §§ 195, 199 of the German Civil Code, BGB).
The voucher is transferable. Whoever presents the voucher code is deemed authorised to redeem it. The provider is not obliged to verify entitlement.
In the event of loss or theft of the voucher, the provider may issue a replacement, provided that the Buyer can prove the purchase and the voucher has not yet been redeemed. There is no entitlement to replacement.
§ 7 Right of Withdrawal
Consumers have a statutory right of withdrawal. Details can be found in the Right of Withdrawal notice.
§ 8 Warranty
Statutory provisions apply.
§ 9 Liability
The provider is liable without limitation for intent and gross negligence, as well as for damages resulting from injury to life, body, or health.
In the case of simple negligence, the provider is only liable for breach of essential contractual obligations („cardinal obligations" — obligations whose fulfilment is essential for the proper performance of the contract and on whose compliance the Buyer may regularly rely), and only to the extent of the typical, foreseeable damage.
§ 10 Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), available at ec.europa.eu/consumers/odr.
The provider is not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 11 Applicable Law, Place of Jurisdiction
The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If the Buyer is a consumer and has their habitual residence in another EU Member State, the mandatory provisions of that Member State remain unaffected.
The place of jurisdiction for all disputes arising from this contractual relationship is, to the extent legally permitted, Hamburg.
§ 12 Severability
Should individual provisions of these Terms be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the statutory regulation.
